2.  Identify and describe two actions that organizational leaders could implement to increase the likelihood of successful defense against these claims. Explain why and how these actions could be helpful in such a case.

Situation 

Trae Rogers was a bus driver for the Los Angeles Rapid Transit Authority. The company had a substance abuse policy that required drivers to be tested after accidents. Rogers ran into a pole. As required, he submitted blood, saliva, and urine samples, all of which tested positive for cocaine. Rogers was fired. He sued, claiming that the drug test was an unreasonable search in violation of the Fourth Amendment to the Constitution.
